The newly constituted guidelines for India’s IT Act will oppress the right to freedom of expression and privacy.  Precisely, the rules don’t necessarily infringe on the right to privacy laid by the Supreme Court’s Puttaswamy Judgement in 2017.

It orders intermediaries like Twitter, Facebook, Whatsapp, Telegram, etc, to vestige tweets, posts, and texts to their sources. Reports reveal that Facebook Messenger and WhatsApp, Telegram, and Signal will have to change their system of dealing with texts. IT minister Ravi Shankar Prasad said that the new guideline requires platforms to trace the ‘first originator’ spreading offensive information. The law is an attempt to deal with issues such as the persistent spread of false news, the abuse of these platforms to share morphed images of women, and content related to revenge porn or to settle corporate rivalries.

Public Policy Advisor at Mozilla Corporation, said,” “In their current form, these rules will undeniably harm freedom of expression, privacy, and security and could be subject to legal challenges. Provisions like traceability of encrypted content, harsh content takedown timelines, and automated content filtering are blunt and disproportionate to the intention behind these changes.”

Contradiction by the CIS Chief

Gurshabad Grover, as a senior policy officer at the Centre For Internet Society, said that minimizing data is a core principle of data protection, but the new rules contradict it. Many private messaging apps get currently delete their mega databases about the message. These apps will have to reboot their system to comply with the new demand. Grover said, ” the new rules will put companies offering end-to-end encryption in a bit of a pickle.”
