Bilkis Bano Rape Case: Is Just Held Hostage?

The worth of a civilization can be judged from the position that it gives to women. One can easily decipher the progress of a society looking at how it loves and respects it womenfolks. Women are the symbols of love, affection, patience, selflessness and compassion. One of the greatest virtues of women is that they are dignified and self-respectful. They might sacrifice for others but can never compromise with the dignity. But, when these very devinely dignity is violated, the same woman assumes the furious avatar of Kali. All these virtues make her closest to God.

The duty of a society, collectively, is to protect the very dignity of the woman. Her beauty, piousness and elegance are to be worshipped. Woman’s empowerment doesn’t only mean her economic and political freedom but also her right over her own body and mind. She must not be forced in any sphere of life. Her choices of profession, cloth, marriage are to be respected. A progressive society would always respect her reproductive right- as to when, how and with whom to produce child or not. Rights are not inalienable to men only, they are equally for women.

However, there are always disgruntled elements in society who have tried to establish dominance over the other sex. These elements often consider woman to be their source of pleasure- as if the women were stripped of any form of human rights. Throughout ages, one would see that women are often victims of male-dominant world. At times, they were robbed off their agency and put to different usage by men. History is a witness to the atrocities against women.

It is not beyond fathamable that some men think women to be born for male pleasure. But, it pains when the same is not detested by the society. Recently, the convicts of Bilkis Bano rape case have been released under remission of prison terms by the Gujarat Government.

It is to be noted that the release was in contravention of guidelines issued by both the federal government and the Gujrat state government. Both say that rape and murder convicts cannot be granted remmission. Life terms in these cases are usually served until death in India. However, they have been released after 14 years of incarceration. The Gujrat Government had released all the 11 convicts under the old remission plea of 1992 as the sentence of life imprisonment was pronounced in 2008.

Those who are uninitiated, Bilkis Bano was raped by the convicts on 3rd March, 2002 and killed 14 of her family members. They are not normal criminals. They are charged with both murder and rape.

But the Gujrat Government, for reasons best known to them, have remmissioned their sententence. Some are of the opinion that the BJP Government was appeasing to the majority. Remmission and reprieve are not unusual. But does it suit this case? For whatever reason, it just sends a wrong message to the society. If one can get away after conviction in rape case, then it just puts a question mark to the societal yardsticks.

It is said that justice should be seen to be done. It may be that the government has taken the decision keeping in view other yardsticks. However, people would tend to see it as an injustice merely on the basis of religion of victim and the convicts. The government should rethink over the decision. Even if the government had taken the decision, she should have been taken into confidence. Who would take the resposibility of her safety?
